1. General Overview

Exotic Pets 701 is a licensed retail business operating in the State of California that sells reptiles, exotic birds, freshwater fish, saltwater fish, and other exotic animals, as well as related enclosures, food, and equipment.
By purchasing from or visiting Exotic Pets 701, you agree to abide by these Terms of Service and all applicable California state and federal laws.

2. Eligibility and Legal Ownership

  • Buyers must be 18 years or older to purchase live animals.

  • It is the buyer’s responsibility to verify and comply with all federal, state, and local laws regulating ownership, possession, and transport of exotic species, including but not limited to:

    • California Fish & Game Code,

    • U.S. Endangered Species Act, and

    • USDA APHIS Animal Welfare Act (7 U.S.C. § 2131 et seq.).

  • By completing a purchase, the buyer affirms they are legally permitted to own the species purchased and understand any permitting requirements.

3. Animal Health and Condition of Sale

  • All live animals are sold in healthy condition to the best of our knowledge at the time of sale.

  • Once an animal leaves our facility or is delivered to a carrier or customer, Exotic Pets 701 relinquishes all liability for its health, behavior, or survival.

  • The buyer assumes full responsibility for proper habitat, diet, environment, temperature, and ongoing veterinary care.

4. All Sales Final — No Refunds or Returns

  • Due to biosecurity, disease-prevention, and animal-welfare considerations, all sales are final.

  • No returns, refunds, or exchanges are accepted on any live animal, feeder, aquatic livestock, or product that has left our facility.

  • Equipment, tanks, and supplies are also non-returnable once sold or opened.

  • This policy complies with California Civil Code § 1723(b)(3), which permits businesses to post a “No Refunds/All Sales Final” policy when clearly displayed prior to purchase.

5. Payment and Deposits

  • Payment in full is required at the time of purchase.

  • Accepted forms of payment include [insert accepted methods].

  • Any deposit or hold fee on an animal is non-refundable unless otherwise stated in a written agreement signed by both parties.

6. Shipping and Live Arrival (If Applicable)

  • Live animal shipments are made only through approved live-animal carriers (e.g., FedEx via Redline Shipping) and in accordance with USDA APHIS and IATA Live Animal Regulations.

  • Buyer must be present to receive the shipment on the first delivery attempt or pick up the package promptly from the designated hub.

  • Failure to receive the animal on time voids any live-arrival guarantee.

7. Store Conduct and Animal Handling

  • Customers may handle animals only under staff supervision.

  • Exotic Pets 701 reserves the right to refuse service to any individual for safety, legal, or ethical reasons.

  • Photography or recording may be restricted to protect animal welfare and customer privacy.

8. Assumption of Risk and Limitation of Liability

  • The buyer acknowledges that handling or owning exotic animals carries inherent risks.

  • Exotic Pets 701, its owners, and employees shall not be liable for any injury, illness, property damage, allergic reaction, or financial loss arising from the purchase, ownership, or handling of any animal or product.

  • All animals and products are sold “as is” without warranties, express or implied, including but not limited to fitness for a particular purpose.

9. Compliance with Animal Welfare and Consumer Protection Laws

Exotic Pets 701 operates under and complies with applicable standards set by:

  • California Department of Fish and Wildlife (CDFW),

  • U.S. Department of Agriculture (USDA-APHIS), and

  • Federal Trade Commission (FTC) guidelines for retail transactions.

10. Dispute Resolution and Governing Law

  • Any dispute arising under these Terms shall be governed by the laws of the State of California and the laws of the United States applicable therein.

  • Venue for any claim shall lie in the Superior Court of California, County of [Insert County].

  • The parties agree to first attempt to resolve disputes through good-faith negotiation or mediation before litigation.

11. Policy Updates
